By accessing or using our website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

BookZync provides an AI front desk for service businesses, including dental and medical practices, medspas, salons, gyms, home service businesses, restaurants, and veterinary clinics. Depending on your subscription, the Services may answer website chats, qualify inquiries, book appointments, capture leads, provide analytics, and support customer communication. In these Terms, the “Services” mean the BookZync platform and everything we provide through it, including (on Prime) custom website development; human review is available whenever needed. Available features may vary depending on your subscription plan, and any custom-website timelines, deliverables, and ongoing hosting will be outlined in a separate client agreement upon purchase.

How we handle your customers' data as your processor is governed by our Data Processing Agreement. For dental, medical, and medspa practices, a dedicated client agreement additionally governs how customer records are collected, retained, and protected.

While the BookZync AI assistant aims to provide highly accurate responses, artificial intelligence is an emerging technology that may occasionally generate inaccurate information (“hallucinations”).

BookZync cannot guarantee that every AI-generated response will be complete, accurate, or suitable for every situation. It is the responsibility of the business to monitor the AI assistant's interactions and provide correct knowledge-base documents during setup. Customers remain responsible for verifying AI-generated information before relying on it, particularly in regulated industries such as healthcare.

For medical and healthcare contexts: the BookZync AI assistant is explicitly trained never to diagnose, give medical advice, or attempt to handle emergencies. Urgent symptoms are directed to local emergency services or your clinic's urgent line. You are responsible for ensuring that the information used to train your AI assistant remains accurate and up to date.

You agree to:

• Provide accurate information about your services, hours, pricing, and policies when training the AI assistant.
• Review the AI assistant's conversations periodically and notify us of any recurring errors so we can retrain.
• Use the Services in compliance with all applicable laws, regulations, and industry requirements — for example, data-protection and marketing-consent laws (such as TCPA in the US, GDPR in Europe, and CASL in Canada) and industry-specific rules (such as HIPAA for US healthcare, PIPEDA and provincial health-privacy laws such as PHIPA for Canadian practices, or your country's equivalent).
• Comply with the terms of any third-party services you connect to your BookZync account.
• Do not use BookZync to send spam, harass individuals, or transmit unlawful messages.

The original content, features, and functionality of this website and the BookZync platform are and will remain the exclusive property of BookZync and its licensors. Subject to these Terms, BookZync grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services for your business. You retain ownership of the business-specific content and information you provide to us.

On Prime, custom websites built for clients will have ownership rights transferred according to the specific client contract. Generally: design, copy, and codebase ownership transfers to you after the final invoice is paid; the underlying chat platform remains BookZync's.

We may terminate or suspend access to the Services immediately, without prior notice or liability, for any reason — including but not limited to a breach of these Terms.

On termination, your right to use the Services ceases immediately. You will have 30 days to export your lead and conversation data before deletion. Any refunds will be governed solely by our Refund Policy.

We reserve the right to modify or replace these Terms at any time. We will notify active subscribers of material changes by email at least 30 days before they take effect. Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms.

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied — including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. BookZync does not warrant that the Services will be uninterrupted, error-free, or secure, or that the AI assistant's output will be accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

To the maximum extent permitted by law, BookZync and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services — even if BookZync has been advised of the possibility of such damages.

BookZync's aggregate liability for all claims arising out of or related to the Services will not exceed the total amount you paid to BookZync in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless BookZync and its officers, employees, and suppliers from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of: (a) your use of the Services; (b) the information and content you provide or that you collect from your own customers; and (c) your violation of these Terms or of any law or regulation applicable to your business, including data-protection, marketing-consent, and industry-specific rules.

When you use SMS features, messages are sent only to recipients who have provided the necessary consent, and you are responsible for obtaining and maintaining that consent. Recipients may opt out at any time by replying STOP, and may request help by replying HELP. Message frequency varies, and message and data rates may apply. Our Privacy Policy describes how we handle SMS opt-in information.

BookZync is operated by BOOKZYNC (OPC) PRIVATE LIMITED, a company incorporated in India (registered office: J-506 Golden Domes, Jagatpura, Jaipur, Rajasthan 302017, India). These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law rules.

The parties will first attempt in good faith to resolve any dispute arising out of or relating to these Terms. Any dispute not resolved through good-faith discussion will be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.
